03. Quotations & Pricing

• All quotations are:
  • Time-bound
  • Subject to market fluctuations (especially scrap prices)
• Final pricing depends on:
  • Quantity
  • Grade/specifications
  • Logistics
  • Site conditions (for projects)

04. Orders & Contracts

• Orders are confirmed only upon:
  • Written confirmation OR
  • Advance payment OR
  • Signed agreement
• For large projects:
  • Separate contract agreement overrides these Terms

05. Payment Terms

• Payment modes:
  • Bank transfer
  • Online payments
  • Any mutually agreed method
• Standard conditions:
  • Advance required (especially for machinery/projects)
  • Balance before dispatch or as per contract
• Late payments:
  • May attract interest
  • May result in suspension of services

06. Delivery, Risk & Title

• Delivery timelines are indicative
• Risk transfers:
  • At dispatch OR
  • As per contract/Incoterms
• Title (ownership) passes only after:
  • Full payment is received

07. Scrap & Material Clause

All scrap and recycled materials are sold on:

• Exact composition
• Metal recovery percentage
• Absence of contamination

Buyer assumes full risk after purchase.

08. Machinery Sales Clause

For used machinery:

• Sold on “as-is” basis unless specified
• No warranties on:
  • Performance
  • Lifespan
  • Hidden defects

Inspection before purchase is buyer’s responsibility.

09. Excavator & Equipment Hiring

• Client is responsible for:
  • Safe usage
  • Operator instructions (if applicable)
  • Site readiness
• Company is not liable for:
  • Site damages
  • Delays due to site conditions

10. Construction & Project Services

For industrial sheds, PEB construction, and infrastructure projects:

• Timelines depend on:
  • Site readiness
  • Weather
  • Government approvals
• Variations:
  • Any design or scope change = additional cost

11. Dismantling Services

For Buildings, Plants, and Machinery:

Client must:

• Ensure legal permissions
• Provide safe access

We are not liable for:

• Pre-existing structural risks
• Third-party damages outside scope

12. Inspection & Claims

• All goods/services must be inspected:
  • At delivery OR
  • Immediately after execution
• Claims must be raised within:
  • 24–48 hours

Else, deemed accepted.

13. Returns & Refunds

• No returns for:
  • Scrap materials
  • Used machinery
• Refunds (if any):
  • Only in exceptional cases
  • At company’s discretion

14. Limitation of Liability

We are not liable for:

• Indirect or consequential losses
• Loss of profit/business
• Market price fluctuations

Maximum liability: → Limited to transaction value

15. Force Majeure

We are not responsible for delays due to:

• Natural disasters
• Government restrictions
• Supply chain disruptions
• Labor issues

16. Compliance & Legal

Clients must comply with:

• Environmental laws
• Scrap handling regulations
• Safety standards

17. Confidentiality

All pricing, contracts, and business dealings are confidential.

18. Termination

We can terminate services if:

• Payment default
• Misrepresentation
• Breach of agreement

19. Governing Law

These Terms are governed by:

• Indian Contract Act, 1872
